Article 1

This reservation contract is for the exclusive use of booking a stay in a rural gîte.
Under no circumstances will Mr or Mrs DURY Alain be held responsible for the use of these contracts by third parties or for purposes other than tourism.

Article 2 – length of stay

The customer who signs this contract for a fixed period may not, under any circumstances, claim any right to remain in the property at the end of the stay.

Article 3 – conclusion of the contract

The reservation becomes effective once the customer has sent the owner a deposit of 50% of the total price of the holiday and a copy of the contract signed before the date indicated in the contract. A second copy must be kept by the customer.
Under no circumstances may the contract concluded between the parties to this deed benefit, even partially, third parties, whether natural persons or legal entities, without the written agreement of the owner.
Any breach of this last paragraph may result in the immediate cancellation of the holiday to the detriment of the customer, with the price of the holiday remaining the property of the owner.

Article 4 – Cancellation by the customer

All cancellations must be notified by registered letter to the owner

a/ Cancellation before arrival: the deposit remains the property of the owner. The owner may ask for the balance of the stay if the cancellation is made less than 30 days before the date of arrival. If the customer does not show up within 24 hours of the arrival date indicated on the contract, the present contract becomes null and void and the owner may dispose of the gîte. The deposit also remains the property of the owner, who will ask for the balance of the stay.
b/ if the stay is shortened: the price of the stay remains the property of the owner. No refund will be made.

 

Article 5 – Cancellation by the owner

The owner will pay the customer the full amount paid.

Article 6 – Arrival

The customer must arrive on the day and at the time specified on this contract. In the event of late or delayed arrival, the customer must inform the owner.

Article 7 – Payment of the balance

The balance of the price of the stay must be paid on arrival.

Article 8 – Inventory of fixtures

An inventory is drawn up jointly and signed by the client and the owner or his/her representative on arrival and departure. This inventory is the only reference in the event of a dispute concerning the state of the premises.
The state of cleanliness of the gîte on the customer’s arrival must be noted in the inventory. Cleaning of the premises is the responsibility of the customer during the stay and before departure. The amount of any cleaning costs is calculated on the basis given in the description.

Article 9 – Security deposit

On the customer’s arrival, the owner will ask for a security deposit, the amount of which is indicated in this contract. After an inventory of fixtures has been drawn up by both parties at the end of the rental period, this deposit will be returned, less the cost of repairing the property if any damage has been found.
In the event of early departure (before the time stated on this contract), which prevents the inventory of fixtures from being drawn up on the day of the customer’s departure, the security deposit will be returned by the owner within a period not exceeding one week.

Article 10 – Use of the premises

The customer must ensure the peaceful nature of the gîte and use it in accordance with its intended purpose.

Article 11 – Capacity

This contract is drawn up for a maximum capacity of guests. If the number of guests exceeds the capacity, the owner may refuse to accept additional guests. Any modification or breach of contract will be considered to be at the customer’s initiative.

Article 12 – Animals

This contract specifies whether or not the customer may stay with a pet. Should the customer fail to comply with this clause, the owner may refuse access to the premises to animals. In this case, any modification or termination of the contract will be considered to be at the customer’s initiative.

Article 13 – Insurance

The customer is responsible for all damage caused by him/her. They are required to take out holiday insurance to cover these various risks.

Article 14 – Payment of charges

At the end of the stay, the customer must pay the owner any charges not included in the price of the stay.
The amount of these charges is calculated on the basis given in this contract and in the description of the property, and a receipt is provided by the owner.
